After 28 days in jail, the two Church men were tried on
Tresspass 2 charges. In his opening remarks, Christian
Livingstone said that the Church held the paramount title to the
property at 8777 Basl Hill Road, That Marion County officials
engaged in an unlawful conversion of the Church's property, even
using military tank and swat team to eject the Church, and that
following the raid, District Court Judge Don Dickey sealed the
case file regarding the Church Property at the request of Marion
County officials.
Christian Livingstone concluded, It is our firm conviction that
the property conversion is based on fraud, so much that Church
members have placed themselves at great risk and have been
jailed on three occasions since the original military raid raid on January 31, 1997. Therefore,
we have never knowingly and unlawfully trespassed.
During the March 9th trial, deputy Brewster read Donald
Cleveland Ross's written Orders from the Church to set up an
embassy Outpost, including his special instructions which read,
"But beware of men: for they will deliver you up to the
councils, and they will scourge you in their synagogues; And ye
shall be brought before governors and kings for my sake, for a
testimony against them and the Gentiles." (Mathew 10:17)
Jay Lamb, who initiated the trespass charges, claimed ownership
to the 34-acre Church property which was unlawfully seized by
the County for nonpayment of property taxes. The prosecution did
not show a deed or any written proof that Jay Lamb was the
owner. They only said that Jay Lamb bought the property legally.
Jay Lamb admitted on the stand that he had not posted the
property, that he had not identified himself as the owner to the
Church members, nor did he ever ask Church members to leave the
property. Therefore, Church members could not unlawfully and
knowingly trespassed.
Nevertheless, a six person jury found Christian Livingston and
Donald Cleaveland Ross quilty of Trespass 2 on March 9, 1998 and
released them.
The two Church members were also served Stalking Orders, which
is similar to a Restraining Order. According to the orders, if
either of them come into the visual presence of Jay Lamb or his
immediate family or make any deliberate attempt to contact him
in person or by phone, mailing, or going through a third party,
they are subject to arrest. Each was fined $1,000 to be paid to
the victim Jay Lamb.
If thou seest the oppression of the poor, and violent
perverting of judgment and justice in a province, marvel not at
the matter: for [he that is] higher than the highest regardeth;
and [there be] higher than they. (Ec 5:8)
None calleth for justice, nor [any] pleadeth for truth: they
trust in vanity, and speak lies; they conceive mischief, and
bring forth iniquity. (Isa 59:4)
And judgment is turned away backward, and justice standeth afar
off: for truth is fallen in the street, and equity cannot enter.
(Isa 59:14)
Christian Livingstone had been stapling two different notices on
public bulletin boards and on utility poles warning people that
Jay Lamb was attempting to sell Embassy of Heaven Church
property without clear and marketable title and warning that the
trees on the Church grounds had protective metal devices
installed.
Christian had just finished posting a notice to a utility pole
at a busy intersection when he noticed a Marion County cruiser
following him. He completed his business at the post office in
Stayton and then rode 2 miles into Sublimity. He posted notices
on the bulletin board at the local grocery store, then went
down Church Street to St. Boniface Catholic Church. As he pulled
into the Church parking lot, a Marion County cruiser started
flashing his lights.
A female Marion County Deputy approached Christian on his
bicycle and ordered him not to post anymore public notices.
Soon four more vehicles arrived as back up, including another
Marion County cruise, two Stayton Police cars and an undercover
vehicle. Christian asked the Stayton Police for the specific
ordinance prohibiting the posting of Public Notices. The
officers could not give any specifics. [No
ordinance had been passed at this time. These men dressed as
police but exceeding the authority of their office and acting
under the color of law would have to go back and conspire with
the Mayor and others to have an ordinance signed in order to
stop the Church from getting the truth out.] One officer
warned that there would be serious consequences if Christian
continued posting notices. Christian said there would be
heavenly consequences if Marion County continued persecuting the
Church.
Christian said he was posting the notices because the Church
wanted to get the truth out to the people. He also said he would
meet with the Church and they would decide whether or not to
keep posting Public Notices.
Christian asked the female deputy, "Where would you draw the
line between good and evil? Would you have manned the road
block for the Feds at WACO?".
Before she could answer, he asked, "Would you have participated
in a raid against a certain Church last January?" She admitted
she had already participated in that raid.
Rachel Revere, who took the call, asked if there was a specific
Ordinance forbidding such posting. The Stayton representative
sited City Ordinance 17.20.960 - Prohibited Signs, Section L.
[This ordinance was evidently passed for
the sole purpose of muffling the Church which is a continueing
effort to conseal the truth. The county has sealed the records
and now the city is aiding in an obstruction of
justice.]
Revere commented, "We have often seen Garage Sale notices posted
on utility poles and bulletin boards. We had no idea that the
posting of public notices was forbidden. When did such a notice
go into effect?"
Donna of the Stayton Police said the Ordinance had just been
signed by the Mayor and went into effect February 9. This was
the very day Christian Livingstone had been stopped on his bike
and warned not to post notices.
Donna said the staples used in posting notices damage the life
of the utility poles. If the Church wants to continue posting
public notices on utility poles, they must first get a million
dollar bond from the utility company and a sign permit from the
city of Stayton. She also said the Church was misusing the post
office bulletin boards and they would continue removing our
Public Notices. Donna commented that the feed store was upset
because the Church was abusing their bulletin board. "Their
message board is for farmers to sell chickens, hay and garden
produce not for posting Public Notices."
The Church plans to continue posting Public Notices exposing the
Truth as the Lord Jesus Christ directs. "We ought to obey God
rather then men" quoted Pastor Revere. (Acts 5:29)
Lutz, who was obviously drunk, kept saying to the men of the
Church, "You don't know how badly I want to kick your, you know
what! I'd like to smash your face in and through you in the
ditch."
[Where are the good Samaratans in Marion
County?]
The two men were held at gunpoint. As they waited, Christian
said, "Hey you have guns, we don't have guns."
Lutz Retorted, "Oh, you want a gun?" Then he grabbed the 12
gauge shotgun from Jay Lamb and tried to force the gun into
Christian's hand. Christian grabbed the gun barrel so that
during the struggle if it went off it would not hurt anyone.
Deputy sheriffs eventually arrived and arrested the Church men
on charges of "Trespass 2" for entering their own Church
grounds. Embassy of Heaven Church member have been occupying
the Church property since they were violently ejected by Marion
County on January 31, 1997, for nonpayment of property taxes.
Though details are still coming in, Don Ross reported from jail
to his mother, Joyce Stogedill that Jay Lamb, Troy Lutz, Mark
Echelmann and another man are on the Church property, armed and
waiting for more Church member to come. They had been drinking
and carelessly waving guns around. One man especially wants to
hurt someone.
Mike Heater reported that Sergeant Duane Fletchall, who led the
military raid against the Church last year, left a note inside
the Church addressed to any members saying, "We'll get you next
time."
goto: previous angry displays by Jay
Lamb.
Christian and Donald were hauled to the Marion County Jail
where they were arraigned on Trespass 2 charges, which carry a
maximum jail time of thirty days. Neither man submitted to
booking or photographing. A hearing is scheduled for February
18th at 8:30 a.m. and a trial on the Trespass charges is
scheduled for March 15th. Donald says, "We are both fasting and
it looks like we will be in here a long time."
Donald Cleveland Ross was brought before Ms. Hughes on February
18th and confessed that his citizenship in in Heaven. Hughes
replied, "You do not have to be a citizen of Oregon in order to
be prosecuted by Oregon."
When Don was informed that Ms. Hughes would plea for hism if he
did not plea, Don said, "If I were to make any plea or pay any
bail, I would be turning my back on Jesus Christ who has paid
for my redemption."
Ms. Hughes said, "You are accused of trespassing on the
address of 8777 Basl Hill Road.
Don replied, "That is the Embassy of Heaven Church."
Ms. Hughes then gave the specifics of the charge. She said,
"You were on a place that was not open to the public, and you
were there unlawfully without the privilege of being allowed
there, and when asked to leave by the person in charge, you did
not leave."
Don said, "I was confronted by a drunken man at gun point. The
man did not identify himself or ask me to leave."
Ms. Hughes replied, "You will be remaining in D-Pod for about 3
weeks."
Don said, "I will be continuing my spiritual fast until Jesus
brings about my release. I forgive you your trespasses."
Christian Livingstone was then brought before Ms. Hughes and he
also confessed that he was a citizen of Heaven.
Hughes said, "It does not matter what citizenship you have, you
can be prosecuted by me anyway."
Christian said the charges were false and that he had no need
to plea to false charges.
Christian objected to having a court appointed attorney, saying
he already had assistance of counsel. The court-appointed
attorneys for both men were discharged.
Hughes attempted to have the men waive their right to a jury
trial, but they did not. A jury trial is set for March 9th. Both
men are to be tried jointly.
"Redemption is deliverance from the power of an alien
dominion and the enjoyment of the resulting freedom. It involves
the idea of restoration to one who possesses a more fundamental
right or interest. The best example of redemption in the Old
Testament was the deliverance of the children of Israel from
bondage, from the dominion of the alien power in Egypt."
Zondervan's Pictorial Encyclopedia of the Bible, "redemption"
Please pray for Jay Lamb, that he repents of molesting the
Church. Surely he is not treating others the way he would like
to be treated.
Please write or call Jay Lamb and urge him to reconsider his
action. The Church did not defraud him or take his money. The
Church is merely standing on the Truth.

Transcript of Tape:
"This is Jay Lamb. I have sold that property there, that
Embassy property to Map Inc. Corporation out of Oregon City.
Closed last Friday. I am aware they are spiking the trees. Kind
of in their hands now. Thank you. (End of Tape.)
Church members contacted Map Inc. on February 16th to warn them
that the property they thought they purchased belongs to the
Church and that Jay Lamb does not have clear and marketable
title.
Ken Everett of Map Inc. seemed fully aware of the Church's
position and that protective metal devices had been inserted in
the trees to prevent logging. He said they have clear title to
the 34 acres and that it is insured through Key Title Company.
He also said they have hired 24-hour armed guards to patrol the
grounds. "Anyone entering the Embassy grounds will be promptly
arrested for trespassing," he said.
The Church contacted Key Title Insurance Company to find out the
specific terms of the Title Insurance policy issued on the
Embassy Church grounds. The County, after auctioning off their
interest in the Church last year, provided only a quit claim
deed, with no warranties. At least one local title company
assured the Church that they would not issue title insurance on
the property because of the ownership dispute.
Key Title Insurance Company refused to release any information
on the terms of the insurance policy, stating that those files
were sealed to the Church because the Church was not an
interested party of record.
Inside the Church sanctuary, empty beer were scattered with
opened condoms strewn out of the tops of the bottles. Crude
displays, such as a large cross made of raw potatoes, were also
evident. All the Church books and pamphlets, which were in a
large display rack were stolen.
The Church member witnessed strangers occupying the Church until
about 6pm. The men left in two pickups, leaving the lights on,
giving the appearance that they were still there.
Embassy of Heaven Church members were thrown off their Church
property by force in a military type raid on January 31, 1997. The have
peacefully moved back onto the Church property to reaffirm that
the Embassy grounds belong to Jesus Christ and have been set
aside for His purposes.
Pastor Revere remembers those who have contributed their labor,
materials and funds to build these structures that have now been
incinerated. He mentions Hebrews 6:10. "For God is not
unrighteous to forget your work and the labour of love, which ye
have showed toward his name, in that ye have ministered to the
Saints, and do minister."
Embassy of Heaven Church They have been
heard cursing and seen desecrating the Church. It has been
reported that they intend to tear out the valuable wood of the
Church building and then burn it. These men have been patrolling
day and night. They have been camping on the Church grounds. We
believe and we have testimoney backing this belief that Jay Lamb
will have someone start logging within in the next few days.
When logging begins I am sure there will be many men dressed as
police and driving Marion County police vehicles around the
property. It has also been reported to us that Sheriff deputy
Duane Fletchall has left a note stating that he will get the
rest of the Church people later. This note was left by Duane
after Christian and Ross were arrested in the earlier ambush.
After the trees are gone and the building are destroyed we
believe the charges will be dropped and the men will be
released. This lawless element operating under the color of
law will continue to persecute the innocent as long as you
continue to be apathetic. There will be a hearing at Marion
County Jail and Court Annex, on Aumsville Highway, February 18th
of the men arrested.

The beautiful Church
ground and retreat area that has been a refuge and spiritual
sanctuary for those attending the Church as well as a home for a
family of spotted owls for many years is being stripped of its
value.
[Jay Lamb knows that he has no
marketable title. He must also know that the reason he has no
marketable title is that the county employees broke the law when
they raided the Church for non payment of taxes. He is trying to
get his money back by irreparably destroying the value of the
land and property to the Church.
That is the Law.
